Terms of Service

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App. These Terms constitute a legally binding agreement between you and GlowLift.

Effective Date: January 30, 2025

To use GlowLift, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• If you are under 18, have parental or guardian consent to use the App
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet all eligibility requirements.

Account Registration

To access certain features, you must create an account. When creating an account:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not share your account with others or create multiple accounts

We reserve the right to suspend or terminate accounts that violate these Terms.

Description of Services

GlowLift provides the following services:

• Facial Yoga Exercises: Guided video workouts targeting specific facial areas for toning and wellness
• Skincare Routines: Personalized morning and evening skincare routine recommendations
• Product Scanner: Barcode scanning with ingredient analysis and toxicity scoring
• AI Skin Analysis: Camera-based skin condition assessment and recommendations
• Progress Tracking: Streak tracking, progress photos, achievements, and statistics
• Wellness Content: Breathing exercises, meal plans, and educational content

• The facial exercises, skincare recommendations, and wellness content are for informational and educational purposes only
• AI skin analysis is not a substitute for professional dermatological evaluation
• Product ingredient analysis is informational and should not replace consultation with healthcare providers
• Consult a physician before starting any new exercise program or if you have any health concerns
• If you experience any pain, discomfort, or adverse reactions, discontinue use and seek medical attention
• Individuals with medical conditions affecting the face, skin, or jaw should consult healthcare providers before use

We do not guarantee any specific results from using our App. Individual results may vary based on many factors including consistency of use, individual physiology, and other lifestyle factors.

Free and Premium Features

GlowLift offers both free features and premium subscription plans. Some features require an active subscription to access.

Subscription Terms

• Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annually)
• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription prices are subject to change with notice

Free Trial

We may offer free trials. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Any unused portion of a free trial will be forfeited when you purchase a subscription.

Cancellation

You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. Please contact Apple App Store Support or Google Play Support for refund inquiries.

User Content

You may upload content to the App, including photos, profile information, and other materials ("User Content"). You retain ownership of your User Content, but grant us certain rights:

• A license to use, store, and process your User Content to provide and improve our services
• The right to analyze photos for AI skin analysis and progress tracking features
• The right to use anonymized, aggregated data to improve our services and algorithms

You represent and warrant that:

• You own or have the right to upload any content you submit
• Your content does not violate any third-party rights
• Your content complies with all applicable laws

You agree NOT to:

• Use the App for any unlawful purpose or in violation of these Terms
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute our content without permission
• Use the App to harass, abuse, or harm others
• Share your account credentials or allow others to access your account
• Upload photos of other people without their consent
• Use the product scanner for commercial competitive analysis purposes

The App and its original content, features, and functionality are owned by GlowLift and are protected by copyright, trademark, and other intellectual property laws. This includes:

• Exercise videos, tutorials, and instructional content
• App design, graphics, logos, and icons
• Text, images, and other media content
• AI algorithms and analysis technologies
• Software code and underlying technology

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Third-Party Links and Services

The App may contain links to third-party websites, products, or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk and subject to their terms and conditions.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of AI skin analysis or product ingredient analysis
• Warranties regarding specific results from facial exercises or skincare routines

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOWLIFT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your account or data
• Any damages resulting from reliance on information provided through the App
• Any physical injury or health issues arising from use of the App

Our total liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless GlowLift and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending a notification through the App or email for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

We may also modify, suspend, or discontinue any aspect of the App at any time without prior notice.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App
• At our sole discretion for any reason

You may terminate your account at any time by deleting your account through the App settings. Upon termination, your right to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GlowLift operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GlowLift regarding the App and supersede all prior agreements and understandings.

App Store Terms

The following additional terms apply when you download the App from app stores:

Apple App Store

• These Terms are between you and GlowLift only, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms

Google Play Store

• These Terms are between you and GlowLift only, not Google
• Your use of the App must comply with Google Play's Terms of Service
